The Purpose of Estate Planning

A comprehensive estate plan addresses all issues regarding health care decisions, wealth management and preservation,  succession to real and personal property, and care of of your children and grandchildren.  An estate plan is essential for anyone who has children, has certain desires regarding his or her health, and anyone who has any assets that they have a desire to distribute to any specific people or entities, including charitable organizations or churches.

An estate plan generally consists of durable powers of attorney for financial and healthcare decisions, a healthcare directive (the healthcare directive and the power of attorney for healthcare decisions are commonly referred to as a living will),  a trust and/or a will, and other necessary documentary instruments necessary to attain the goals established in our consultations. We also administer wills through probate. The probate process is a court supervised allocation of debts and assets to properly close and wrap up the affairs of a deceased person, commonly referred to as a decedent. Typically, when there is joint owned property, or property that passes directly to heirs and beneficiaries, probate is not necessary. However, when there are creditors and property that does not pass upon the death of a person, probate is generally necessary.

Handelin Law is able to strategically analyze the totality of a decedent’s estate in order to efficiently and effectively accommodate ascertainable and worthy creditors in order to provide the maximum wealth preservation and allocation in accordance with the decedent’s expressed desires.
